Montana State Auditor and Commissioner of Securities and Insurance James Brown says a recent Montana Supreme Court ruling underscores the need for stronger oversight of the bail bond industry. “Public safety is our absolute top priority here at the auditor’s office,” Brown said. His agency regulates bail bondsmen because they operate as licensed surety insurance agents. Brown said increasingly volatile encounters have raised concerns about how defendants are apprehended. “We’ve seen some Wild West tactics that are resulting in people dying,” he said, adding that those incidents undermine confidence in an industry responsible for helping ensure defendants return to court…
Brown said his agency’s concerns also include financial exploitation and abuse of people who owe money on bonds. He pointed to a Kalispell case involving allegations that a bondsman demanded sexual services to satisfy purported debts and improperly retained vehicle titles used as collateral. Brown said the agency suspended and ultimately permanently revoked that bondsman’s license. “You can see where this is an area that could be ripe for abuse,” he said. For Brown, enforcement and professional standards serve the same purpose: “First of all, we don’t want people dying during recoveries on bail bonds.”
