Service of Process


CSI is no longer the default registered agent to accept service of process against foreign and alien insurers. As of July 1, 2019, House Bill 65 requires insurers to appoint a registered agent who either resides or maintains a business address in Montana. An insurer’s failure to appoint a registered agent may result in an administrative fine.


Appointing a Registered Agent

All foreign and alien insurers must appoint a registered agent as follows: 
  • Complete a Form 12
  • Make a $10 check payable to Montana State Auditor
  • Mail the Form 12 and check to:

Finding a Registered Agent

To search for a registered agent:
  • Go to https://sbs.naic.org/solar-external-lookup
  • Set Montana as Jurisdiction
  • Set Company as Search Type
  • Enter company name
  • Agree to NAIC’s Terms and Conditions
  • Select company from the list
  • Service of Process is under the Contact heading
If you are unable to locate a registered agent:
  • Execute an affidavit stating that the agent cannot be found on the website
  • Make a $50 check payable to Montana State Auditor
  • Mail two copies of the documents to be served, the affidavit, and the check to:
