Registration & Fees

The Montana Securities Department uses FINRA’s Central Registration Depository to register FINRA member firms. All of the paperwork and fees are submitted to the FINRA Central Registration Depository. If your firm is not a FINRA member firm, you can send the required materials directly to our office. Fees for registration are outlined in MCA, 30-10-209.

NOTICE TO FINRA BROKER-DEALER FIRMS
Montana does not require firms to provide audited financials unless so requested. We are a paperless state. 30-10-201(11), MCA.

ANNUAL RENEWAL REQUIREMENTS FOR ISSUER-APPOINTED SALESPERSONS
Please submit a $100 registration fee AND a copy of page 1 of the most recent U-4 form. PLEASE NOTE: Salespersons selling for issuers with portfolios must be registered with each portfolio. If the salesperson is registered with more than one portfolio, you need only provide one copy of page 1 of the most recent U-4 form and attach a list of portfolios. Please be sure the fund name is correct on the U-4 form.

INCOMPLETE FILINGS WILL DELAY RENEWALS. The deadline for renewals is December 31.

SECURITIES REGISTRATION  & FEES

  • Uniform Form BD, in its most recently revised form, with the original signature and notary
  • For FINRA firms, make payable to the CRD
  • Non-FINRA firms make payable to Montana State Auditor
  • Uniform Form U-4, in its most recently revised form, with original signature
  • Montana residents are eligible for a $50 refund to create a net fee cost of $50. Montana residents must submit the below Affidavit of Residency to be refunded $50 with a W-9.
  • Montana Affidavit of Residency
  • For FINRA firms, make payable to the CRD
  • Proof of passing the Series 63 or 66 exam
  • IA Firm Registration includes information regarding the filing types for firms, a link to the current version of the ADV forms, and user support tools available to guide you through a filing.
  • ADV 2 Guidance: IARD system instructions on filing Part 2 of your firm’s Form ADV
  • IA Representative Registration includes information regarding filing types for IA representatives, a link to the current version of the Uniform U-4 and U-5, and user support tools available to guide you through filing.
  • Montana Affidavit of Residency form must be submitted by Montana residents to be refunded $50
  • Montana’s administrative rule, ARM 6.10.501, requires an investment adviser representative applicant pass the FINRA uniform exam, namely, the Series 65, 66 or 24 “or an exam designated by the commissioner.” In lieu of passing the Series 65, 66 or 24, the state of Montana allows waivers for some applicants holding professional designations.
